What is the minimum notice period when resigning in Malaysia?

The Employment Act (1955) sets out the minimum notice periods that employees must provide when resigning in Malaysia. 

  • 0 – 2 years employment – 4 weeks
  • 2 – 5 years employment – 6 weeks
  • 5+ years employment – 8 weeks

What are the consequences of an insufficient notice period in Malaysia?

If an employer/employee fails to provide the required notice, they are required to pay the other party an indemnity in lieu of notice.  The value of the indemnity is calculated as one day’s wage for each day of the required notice period.

Is it possible to reduce the notice period in Malaysia under exceptional circumstances?

Yes. The notice period is a matter of negotiation between the employer and the employee. Provided an agreement is reached in advance, the notice period can be waived by mutual consent.

It depends on the length of the employee’s employment and the terms of the employment agreement. The following minimum notice periods apply both during and after the probationary period:

  • 2 – 5 years employment – 6 weeks
  • 5+ years employment – 8 weeks
