What is the minimum notice period when resigning in Taiwan?

The minimum notice period in Taiwan is based on the length of employment:

  • 0 to 3 months employment: there is no minimum notice, but the standard is 7 days.
  • 3 months to 1 year employment: a minimum of 10 days.
  • 1 to 3 years employment: a minimum of 20 days.
  • Over 3 years employment: a minimum of 30 days.

Payment in-lieu of notice must be paid for immediate terminations. There are a limited set of circumstances where employment can be terminated with no notice or severance pay.

What are the consequences of an insufficient notice period in Taiwan?

Employers who do not provide sufficient notice will be subject to fines of between TWD$ 20,000 and TWD$ 300,000.
